Seeking Disability Information From Third Parties


At the pre-offer stage, an employer is prohibited from seeking disability related information not only from the applicant, but also from any third party, such as the applicant's prior employer or a reference. Accordingly, an employer may not ask an applicant's former employer questions such as: - How many days was the applicant sick last year? - Has the applicant ever filed a workers' compensation claim? - Did the applicant have any on-the-job injuries?
