Medical Examinations As Prohibited Discriminatory Practices


In order to prevent discriminatory practices, the ADA defines prohibited discrimination as including pre-employment medical examinations and inquiries that focus on a job applicant's disabilities. Under the Act, the only legitimate purpose of a medical examination is to determine if the job applicant can perform specific job functions, not to determine if the applicant has a disability.
