Evidence of Essential Job Functions According to EEOC


EEOC's regulations provide that evidence of whether a particular function is ''essential'' includes the following: - The employer's judgment as to what functions are essential; - The employer's written job description, prepared before advertising or interviewing applicants for the job - The amount of time spent by employees performing the particular job function; - The consequences of not requiring the employee to perform the particular job function; - The work experience of past incumbents in the job; - The current work experience of those holding similar jobs; and - The terms of a collective bargaining agreement.
