Employer's Liabilities for Employee's TortsThe common law doctrine of respondeat superior making an employer is responsible/liable for its employee's torts, including intentional torts, if those torts were committed within the scope of employment. The Oregon Supreme Court has established a three-part test to determine whether an employee's conduct was within the scope of employment: the conduct must have occurred substantially within the time and space limits authorized by the employment; the employee must have been motivated, at least partially, by a purpose to serve the employer; and the act must have been of a kind that the employee was hired to perform. |
