Employer Sanctions On Drugs and Alcohol UseThe ADA allows an employer to institute the following requirements with respect to the use of drugs or alcohol: - Prohibit the illegal use of drugs and the use of alcohol at the workplace; - Require that employees shall not be under the influence of alcohol or be engaging in the illegal use of drugs at the workplace; - Require that employees behave in conformity with the policies established under the Drug Free Workplace Act of 1988; and - Require that employees comply with standards established by certain federal departments or agencies, such as the Department of Defense, the Nuclear Regulatory Commission, and the Department of Transportation. |
