Effect of Mitigating Measures In Determining ImpairmentEffect of Mitigating Measures In Determining Impairment The determination of whether a condition constitutes an impairment must be made without regard to mitigating measures. The availability of reasonable accommodation or auxiliary aids such as hearing aids to alleviate the effects of a condition has no bearing on whether the condition is an impairment. It is the scope or perceived scope of the condition itself, not its origin or capacity for being corrected, that determines whether a particular condition is an impairment. |
