EEOC Lawful Qualification StandardsOn its face, the statutory language would appear to make illegal all selection standards that have even the unintended effect of discrimination on the basis of disability irrespective of whether or not there is a business justification for the ''discriminatory'' standards. The EEOC's regulations clarify the broad statutory language by specifying that standards that have a discriminatory effect or perpetuate discrimination of others still are lawful as long as: - The criteria are job-related to the position to which they are being applied; and - The criteria are consistent with business necessity. |
