EEOC Requirements of Essential FunctionsAccording to the EEOC, the inquiry into whether a particular function is ''essential'' initially focuses on whether employees in the position are actually required to perform that function. For example, an employer may state that the ability to take dictation is a function of the position of secretary. Yet, if the employer has never required any secretary to take dictation, this would be evidence that the skill is not an essential function of the position. |
