EEOC’s Interpretation of Prohibition Against Retaliation Under ADA


The EEOC also has interpreted the anti-retaliation provisions of the ADA as protecting requests for reasonable accommodation. Although the EEOC has recognized that a person making a reasonable accommodation request might not ''literally 'oppose' discrimination or 'participate' in the administrative or judicial complaint process,'' nevertheless, that person still is protected from making the request.
