Determining Whether Employer Regards Individual As Substantially Limited In WorkingDetermining Whether Employer Regards Individual As Substantially Limited In Working To determine whether an employer regards an individual as substantially limited in working, one must determine whether the employer (1) perceives the individual as having an impairment that precludes or significantly restricts work only in a particular job or a narrow range of jobs or (2) perceives the individual as having an impairment that disqualifies or significantly restricts the individual from a class of jobs or a broad range of jobs. This means that one must determine what the employer thinks about the impairment and how the employer believes the impairment affects the individual's ability to work. That is, one must identify the work limitations that the employer believes result from the impairment. |
