Definition of Medical Examination Under ADA


Neither ADA nor the EEOC's regulations specifically define the term ''medical examination.'' However, the EEOC has defined the term in its Enforcement Guidance on ''Preemployment Disability-Related Inquiries and Medical Examinations.'' According to the Commission, a ''medical examination'' is a ''procedure or test that seeks information about an individual's physical or mental impairments or health.'' The EEOC has enunciated a number of factors that will be considered in determining whether a particular procedure or test will be deemed a ''medical examination'': - Is it administered by a health care professional or someone trained by a health care professional? - Are the results interpreted by a health care professional or someone trained by a health care professional?
