Defining Employment Relationship Under ADA


Employment relationship is defined broadly and mandates an employer not to discriminate against an individual with disability in regard to any term, condition, or privilege of employment, including: - Job application procedures, recruitment, and advertising; - Hiring, rehiring, and the right to return from layoff; - Upgrading, promotion, and award of tenure; - Demotion, transfer, layoff, and termination; - Rates of pay or any other form of compensation and changes in compensation; - Job assignments, job classifications, organizational structure, position descriptions, lines of progression, and seniority lists; - Leaves of absence, sick leave, or other leave; - Fringe benefits available by virtue of the employment relationship, whether or not administered by the employer; - Selection and financial support for training, including apprenticeships, professional meetings, conferences, and other related activities, as well as selection for leaves of absence to pursue training; - Activities sponsored by an employer, such as social and recreational programs.
