Confidentiality Under ADA


Maintaining confidentiality of medical records is a crucial requirement of the ADA. The results of any medical examinations, whether pre- or post-employment, must be kept confidential so that the information is not disseminated to persons who have no need to learn of the results. To ensure confidentiality, medical records, as well as other information dealing with the medical condition or history of the applicant, must be: - Collected and maintained in separate forms; and - Kept in files segregated from general personnel information.
