Concentration is not a Major Life Activity Under ADASleeping is a major life activity because, according to the court, it is ''a basic activity that the average person in the general population can perform with little or no difficulty, similar to the major life activities of walking, seeing, seeing, speaking, breathing, etc.'' The court, however, disagreed with the EEOC as to whether concentration would concentrate a major life activity under the ADA. According to the court, concentration, in and of itself, is not a major life activity, although it may be a ''significant and necessary component of a major life activity, such as working, learning, or speaking.'' Consequently, the court refused to recognize the plaintiff's claim of being disabled due to her depression because it significantly limited her ability to concentrate. |
