Communicating Accommodations In Advertisements, Job Applications And Employee Handbooks

Employers may include in their employment advertisements a specific provision stating that they are an equal opportunity employer that does not discriminate on the basis of race, color, creed, national origin, sex, or disability. Employers also may wish to consider a more specific statement pertaining to the ADA along the following lines: The employer will not refuse to hire or otherwise discriminate against a job applicant with a disability who is capable of performing the essential functions of the job with or without reasonable accommodation. Equal opportunity policy statements also should be posted in conspicuous places at the employer's facility and included in any employee handbook. Employment application forms should include the same nondiscrimination notice used by the employer in job advertisements.
