Additional Prohibited Drug Related Questions Under ADA


Because prior drug addiction is a disability under the ADA, questions that would reveal whether an applicant had been a drug addict are prohibited. Accordingly, the EEOC advises that questions such as the following may not be asked of job applicants at the pre-offer stage: - How often did you use illegal drugs in the past? - Have you ever been addicted to drugs? - Have you ever been treated for drug addiction? - Have you ever been treated for drug abuse?
