Accuracy of Employer’s Perception Not At Issue The legislative history to the Act makes clear that the individual does not have to demonstrate that the employer's perception is wrong. As the legislative history notes, A person who is covered because of being regarded as having an impairment is not required to show that the employer's perception is inaccurate, e.g., that he will be accepted by others, or that insurance rates will not increase, in order to be qualified for the job.
